SMS PROGRAM TERMS

By opting in to receive SMS messages from Restaurant ROI, you agree to the following:

Description of the SMS Program Restaurant ROI's SMS program sends messages related to your application, account, transactional updates, appointment confirmations, and (with separate consent) marketing and promotional offers regarding our services.

Message Frequency Message frequency varies. You may receive recurring messages based on your activity, application status, or campaign participation.

Message and Data Rates Standard message and data rates may apply based on your mobile carrier and plan. Restaurant ROI is not responsible for any charges from your carrier.

How to Opt Out You may opt out of SMS messages at any time by replying STOP to any message you receive from us. After replying STOP, you will receive a confirmation message and will no longer receive SMS messages from us. To opt back in, reply START.

Carrier Liability Disclaimer Mobile carriers are not liable for delayed or undelivered messages. Restaurant ROI is not responsible for any failure of your carrier to deliver messages, and we make no guarantees about message delivery.

Supported Carriers Our SMS program is compatible with major U.S. carriers including AT&T, T-Mobile, Verizon Wireless, Sprint, U.S. Cellular, and others.

USE OF THE SITE

You agree to use the Site only for lawful purposes. You may not:

Use the Site to transmit harmful, illegal, or fraudulent content

Attempt to gain unauthorized access to any part of the Site

Interfere with the operation of the Site

Use any automated system to scrape, copy, or extract content from the Site

Misrepresent your identity or affiliation

INTELLECTUAL PROPERTY

CLIENT SERVICES

If you engage Restaurant ROI for marketing services, the specific terms of that engagement (pricing, deliverables, timelines) will be governed by a separate agreement, invoice, or written communication between you and Restaurant ROI. These Terms govern your general use of the Site and participation in our SMS program.

PAYMENTS

Test project fees and ongoing service fees are processed through third-party payment processors (such as Stripe). By submitting payment, you authorize Restaurant ROI to charge the agreed amount to your selected payment method. All fees are non-refundable except where required by law or agreed to in writing.

DISCLAIMERS

The Site and our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee specific results from our marketing services. Marketing performance depends on many factors, including market conditions, ad spend, creative quality, and audience response.

LIMITATION OF LIABILITY

To the maximum extent permitted by law, Restaurant ROI shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the Site or services, including loss of profits, revenue, data, or business opportunities. Our total liability for any claim arising from these Terms or your use of our services shall not exceed the amount you paid to us in the 12 months preceding the claim.

INDEMNIFICATION
